The Metropolitan
News-Enterprise has long reported on the courts. Its owner,
the Metropolitan News Company, has now been in court as
a plaintiff, pitted against an influential and monied rival. Its
claim is that Charles T. Munger and an entity he controls, the
Daily Journal Corporation, have used unlawful tactics in attempting
to force MNC out of business.
The
first trial was held in December, 1998. On one key issue, jurors
voted 9-3 in favor of MNC, giving it the needed two-thirds margin,
but on another key issue, the vote was 8-4 in favor of MNC. A
mistrial was declared based on the deadlock. At a trial ending
July 14, 1999, MNC lost.
It
has now filed its opening brief in the Court of Appeal.
